Emergency Medical Conditions (EMC) Under The Florida PIP Law:
Emergency Medical Condition is a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention could reasonably be expected to result in any of the following:
Serious jeopardy to patient health.
Serious impairment to bodily functions.
Serious dysfunction of any bodily organ or part.
EMC Changes the bank balance
An EMC should be completed within the first few chiropractic visits from the date of injury. if the injury is not labeled as an EMC there is a cap of $2,500 of PIP medical benefits, to receive the maximum $10,000 of benefits an M.D., D.O., P.A., or N.P. are the only providers legally authorized to generate a written determination that the insured has an Emergency Medical Condition (EMC).
According to the Statute, a Chiropractor cannot determine if an Emergency Medical Condition exists.

For the foregoing reasons, we hold that section 627.736(11), Florida Statutes (2001), does not apply retroactively to the insurance policy issued to the insureds, because it is a substantive statute. Accordingly, we quash the decision of the Third District Court of Appeal and remand with directions to reinstate the stipulated final judgment and to award attorneys' fees.

Chiropractors or facilities that wish to schedule a same day EMC appointment must call 866-611-4362,
and select option 2. We will make every effort to accommodate these appointments based on provider availability.
Please thoroughly verify and coordinate your patients attendance so we can continue to make these same day services
possible for both your patients and our providers (upon approval it takes approximately 10 minutes for TeleEMC to
setup a same day appointment, and have the chiropractor or facility receive the e-mail to join the TeleVisit).
