Emergency Medical Conditions (EMC) Under The Florida PIP Law:

Emergency Medical Condition is a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention could reasonably be expected to result in any of the following:

  • Serious jeopardy to patient health.
  • Serious impairment to bodily functions.
  • Serious dysfunction of any bodily organ or part.

EMC Changes the bank balance

An EMC should be completed within the first few chiropractic visits from the date of injury. if the injury is not labeled as an EMC there is a cap of $2,500 of PIP medical benefits, to receive the maximum $10,000 of benefits an M.D., D.O., P.A., or N.P. are the only providers legally authorized to generate a written determination that the insured has an Emergency Medical Condition (EMC).

According to the Statute, a Chiropractor cannot determine if an Emergency Medical Condition exists.
